Well I have never heard of an oak tree without acorns but your tree is some type of oak.
Oaks are divided into two groups, white oaks and red oaks. The reds have those deep, pointed lobes as seen in your image. I am thinking maybe a Scarlett oak of some type.

My first thought was also a variety of Red Oak, a/k/a Northern Red Oak (Quercus rubra)
